Any dispute resolution proceeding under these Terms will proceed solely on an individual basis, not as a class, consolidated, joined, or representative action, and both parties waive any right to bring or take part in such proceedings. You acknowledge that our agreement to arbitrate serves as consideration for this waiver.

Although we may modify these Terms, any change to the dispute-resolution or arbitration provisions will not apply retroactively to claims that arose before the modification took effect.

Arbitration

Any arbitration conducted under these Terms will follow the prevailing rules of the American Arbitration Association. The arbitrator’s decision will be binding and may be entered as a judgment in any court with proper jurisdiction. If arbitration is not permitted under applicable law for any reason, both parties waive the right to a jury trial and to participate in any class, consolidated, or representative proceeding.
